цель исследования в настоящей научной статье – обосновать положение о том, что Соборное уложение 1649 г. явилось фундаментом светского кодифицированного уголовного права России, в котором религиозное начало было инкорпорировано в государственно-правовую систему, а не противопоставлено ей. С учетом современных научных исследований в данной области и на основе текста самого памятника проанализированы кодификационная техника, структурная логика, система преступлений и наказаний, а также институты Общей и Особенной части уголовного права. Установлено, что Соборное уложение впервые в отечественной истории осуществило систематизацию уголовных норм по объектам посягательства и обеспечило их единообразное применение посредством печатного воспроизведения. Автором обосновывается тезис о том, что светский характер документа заключается не в разрыве с православием, а в подчинении церковных деликтов публично-правовому регулированию. Особое внимание уделено дискуссии о мере «кодифицированности» Соборного уложения и его влиянии на последующее законодательство вплоть до Свода законов 1832 г. Практическая значимость работы состоит в возможности её использования при чтении общих и специальных курсов по истории государства и права России, уголовного права. the purpose of the research in this scientific article is to substantiate the position that the Cathedral Code of 1649 was the foundation of the secular codified criminal law of Russia, in which the religious principle was incorporated into the state legal system, and not opposed to it. Taking into account modern scientific research in this field and based on the text of the monument itself, codification techniques, structural logic, the system of crimes and punishments, as well as institutions of General and Special criminal law are analyzed. It is established that for the first time in Russian history, the Cathedral Code systematized criminal norms on objects of encroachment and ensured their uniform application through printed reproduction. The author substantiates the thesis that the secular nature of the document does not consist in breaking with Orthodoxy, but in subordinating church torts to public law regulation. Special attention is paid to the discussion of the extent of the "codification" of the Cathedral Code and its impact on subsequent legislation up to the Code of Laws of 1832. The practical significance of the work lies in the possibility of its use in reading general and special courses on the history of the state and law of Russia, criminal law.
